1 Introduction & Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the YKPoint application, website, and related services (collectively, the "Service") operated by YKPoint ("we", "us", or "our").

By creating an account, installing the YKPoint mobile application, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

YKPoint is designed exclusively as a parental monitoring and family safety tool. It is intended for use by parents or legal guardians to monitor devices belonging to their minor children (under 18 years of age). Any other use is strictly prohibited.

You are solely responsible for ensuring that your use of YKPoint complies with all applicable laws in your jurisdiction. Laws regarding parental monitoring of minors vary by country, state, and region. We strongly recommend consulting legal counsel if you are unsure whether your intended use is lawful.

4 Account & Security

4.1 Account Registration

To use the Service, you must create an account with a valid email address and a strong password (minimum 6 characters). New accounts require administrator approval before activation. You agree to provide accurate information and keep it up to date.

Each monitored device is linked to your account through a secure pairing process using time-limited codes or personalized app downloads. Pairing tokens are valid for 10 minutes and can only be used once. Device authentication tokens are valid for up to 2 years and are stored securely on the device.

5 Data Collection & Privacy

When features are enabled by the parent/guardian, YKPoint may collect the following data from the monitored device:

YKPoint does not knowingly create accounts for children under 13. The parent/guardian account holder is the sole user of the Service. Data collected from a child's device is accessible only to the authenticated parent/guardian account and the system administrator. Parents may request deletion of all data associated with their child's device at any time by removing the device from their account or contacting us.

6 Device Permissions & Features

6.1 Android Permissions

The YKPoint mobile application requires various Android permissions to function. Each permission is requested individually through the standard Android permission dialog, and the parent/guardian must explicitly grant each one during the setup process. The app explains the purpose of each permission before requesting it.

The application provides a Master Switch and individual feature toggles. The parent/guardian can enable or disable specific monitoring features at any time through the app interface or the web dashboard. Features include:

Certain features require special Android permissions that must be enabled manually in the device's Settings app. These include:

6.4 Uninstall Protection

When Device Administrator is enabled, uninstalling YKPoint requires a time-limited 6-digit verification code generated from the parent's web dashboard. This code is valid for 15 minutes and can only be used once. The parent can generate a new code at any time to allow removal of the app.

7 Service Availability & Limitations

7.1 Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

The Service uses the device's internet connection (Wi-Fi or mobile data) to communicate with the server. Screen mirroring and file transfers may consume significant data. Administrators may set daily and monthly data quotas per user account.

8 Intellectual Property

The Service, including its software, design, logos, and documentation, is the property of YKPoint and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose as described in these Terms. You may not:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YKPOINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM:

You acknowledge that YKPoint is a monitoring tool and not a substitute for active parenting, direct supervision, or emergency services. In any emergency situation, contact local emergency services immediately.

11 Indemnification

You agree to indemnify, defend, and hold harmless YKPoint, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

You may stop using the Service and request account deletion at any time by contacting us. To fully remove YKPoint from a monitored device, use the Uninstall Protection code from your dashboard (if Device Administrator is enabled), then uninstall the app normally.

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

Upon termination, your right to use the Service ceases immediately. The monitored device's app will lose server connectivity and stop transmitting data. The app can then be uninstalled normally (Device Administrator is released upon account deletion).

13 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and request account deletion.

14 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which YKPoint operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of the governing jurisdiction.

15 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
